Adopted in 2023, this ambitious legislative framework aims to regulate the development and use of artificial intelligence on European soil. In the crosshairs are providers of general-purpose generative AI (GPAI) models, such as ChatGPT, Gemini, and Grok. These measures require technical documentation, a summary of training data, and a copyright policy, while introducing strict rules for models posing systemic risk. European regulation of artificial intelligence has just taken a significant step forward. On August 1, a first set of obligations under the Artificial Intelligence Act (AI Act) came into force. This legislation, considered the most ambitious in the world, aims to regulate the development and commercialization of AI in Europe. Generative model providers, such as those offered by OpenAI, Google, and xAI, are now under scrutiny for complying with these new requirements.<strong>Background to the AI Act<\/strong> Adopted in 2023, the AI Act aims to create a rigorous regulatory framework for AI in Europe. In focus are general-purpose models (GPAI) that have the ability to generate text or images. These new rules aim to ensure that these technologies respect copyright and operate securely, by assessing the risks associated with their use.<strong>New Requirements for Companies<\/strong> Under this new regime, companies must comply with several requirements. They must provide comprehensive technical documentation of models, publish summaries of training data, and ensure copyright compliance. Models identified as presenting a <strong>systemic risk<\/strong> will have to notify the European Commission and demonstrate that they strengthen security and protect fundamental freedoms. <strong>International Reactions<\/strong>As Europe moves forward on the path to regulation, international reactions have been mixed. The most marked opposition comes from the United States, where the Trump administration has expressed its disagreement with this approach, which it considers restrictive. In response, the United States is preparing a \u00ab\u00a0major AI acceleration plan\u00a0\u00bb to counterbalance these regulatory constraints and maintain its technological supremacy. <strong>Business Concerns<\/strong> Tech giants such as Google and Meta have welcomed these rules with caution. Google, while signing the Commission\u2019s code of practice, has expressed concerns about a potential brake on the deployment of AI in Europe. Meta, for its part, has not signed this code, citing too many \u00ab\u00a0uncertainties\u00a0\u00bb in the text, even though they will still have to comply with the regulation or face heavy penalties of up to 7% of global turnover. <strong>Political Clash and Digital Sovereignty<\/strong>Behind these discussions, a broader political clash is looming. By implementing such regulations, Europe is seeking to reaffirm its <strong>digital sovereignty<\/strong>and protect its democratic values. On the other side of the Atlantic, the United States denounces an \u00ab\u00a0inconsistent and restrictive approach\u00a0\u00bb and is considering including these regulations in its future trade negotiations. <strong>Next Steps for AI Legislation<\/strong>The next stages of this regulation will come into force in 2026 and will target high-risk AI in crucial sectors such as education, healthcare, and infrastructure.
